GYMHOUSE MEMBERSHIP AGREEMENT, TERMS & CONDITIONS AND LIABILITY WAIVER
This Membership Agreement, Terms & Conditions and Liability Waiver ("Agreement") is entered into between Scandinavian Gymhouse S.L., trading as Gymhouse ("Gymhouse"), and the undersigned member ("Member").
By signing this Agreement, the Member confirms that they have read, understood, and voluntarily accepted all terms set out below.
ASSUMPTION OF RISK
The Member understands and acknowledges that participation in physical exercise, strength training, cardiovascular training, group classes, use of equipment, and use of Gymhouse facilities involves inherent risks, including but not limited to:
• Physical injury
• Illness
• Permanent disability
• Death
The Member voluntarily accepts and assumes all risks associated with participation in activities at Gymhouse.
HEALTH DECLARATION
The Member confirms that they are physically capable of participating in exercise and training activities.
The Member acknowledges that it is their responsibility to seek medical advice before beginning any exercise program if necessary.
The Member agrees to inform Gymhouse of any medical condition, injury, or limitation that may affect safe participation.
LIABILITY WAIVER
To the fullest extent permitted under Spanish law, the Member releases and holds harmless Gymhouse, Scandinavian Gymhouse S.L., its directors, owners, employees, trainers, contractors, and affiliates from any claims, demands, damages, losses, or liabilities arising from the Member's use of Gymhouse facilities or participation in activities.
This waiver applies only to ordinary negligence and shall not apply in cases of gross negligence, intentional misconduct, or any liability that cannot legally be excluded under Spanish law.
EMERGENCY MEDICAL CONSENT
In the event of injury, illness, or medical emergency, the Member authorizes Gymhouse staff to obtain appropriate medical assistance.
The Member accepts responsibility for any resulting medical or transportation costs.
MEMBERSHIP TYPES
Fixed-Term Memberships
Gymhouse offers fixed-term memberships of:
• 1 Month
• 3 Months
• 6 Months
• 12 Months
Fixed-term memberships are paid in advance, do not renew automatically, and expire automatically at the end of the selected period.
No refunds are available once the membership period has commenced.
Recurring Monthly Membership
Recurring memberships are billed monthly in advance and automatically renew each month until cancelled.
Payment is charged to the Member's registered payment method.
Cancellation notice is current month plus one additional month.
Example:
If a Member submits cancellation today, the membership remains active for the remainder of the current month and one additional billing month. The additional month's payment will be charged and access remains active during that period.
After that period, the membership automatically terminates.
Cancellation requests must be submitted in writing or through the member platform before the next billing date.
No partial refunds are provided.
PASSES AND TRAINING PACKAGES
Short-Term Passes
• Day Pass
• 7-Day Pass
• 14-Day Pass
These passes are paid in advance, do not renew automatically, and expire automatically at the end of the selected period.
All pass purchases are non-refundable.
10-Training Card
The 10-training card:
• Is personal and non-transferable
• Is valid for 12 months from purchase
• Expires automatically after 12 months
Unused sessions are forfeited upon expiration and are not refundable.
PAYMENTS
All memberships, passes, and training packages must be paid in advance.
Failed or declined payments may result in immediate suspension of gym access.
Access will be restored once outstanding balances have been paid.
Gymhouse reserves the right to adjust membership fees and pricing with reasonable notice.
MEMBERSHIP FREEZE
Gymhouse may grant a temporary membership freeze in documented medical cases.
Requests must be submitted in writing together with supporting documentation.
Approval is at Gymhouse's sole discretion.
ACCESS AND MEMBER CONDUCT
Memberships, passes, access cards, RFID tags, mobile credentials, and other access methods are personal and may not be shared.
Unauthorized sharing or misuse may result in immediate termination of membership without refund.
Members agree to:
• Follow all posted gym rules
• Follow safety instructions
• Respect staff and other members
• Use equipment responsibly
Gymhouse reserves the right to suspend or terminate any membership for misconduct, unsafe behaviour, abuse of facilities, or breach of this Agreement.
PERSONAL PROPERTY
Gymhouse is not responsible for loss, theft, or damage to personal belongings brought onto the premises.
Lockers are provided for temporary daily use only.
CCTV SURVEILLANCE
Gymhouse operates CCTV surveillance for security, safety, and crime prevention purposes.
All processing of recorded footage is carried out in accordance with applicable Spanish data protection legislation and GDPR requirements.
DATA PROTECTION
Gymhouse processes personal information for purposes including:
• Membership administration
• Billing and payments
• Access control
• Customer communication
• Legal compliance
Personal data is processed in accordance with applicable Spanish law and the General Data Protection Regulation (GDPR).
RULES AND POLICIES
The Member acknowledges that Gymhouse may establish and amend gym rules, safety procedures, operational policies, and access procedures from time to time.
Such rules form part of this Agreement and must be complied with.
GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of Spain.
Any dispute arising from this Agreement shall be subject to the jurisdiction of the competent Spanish courts.
MEMBER ACKNOWLEDGEMENT
By signing below, the Member confirms that:
• They have read and understood this Agreement.
• They voluntarily accept all terms contained herein.
• They understand the risks associated with exercise and use of gym facilities.
• They agree to comply with Gymhouse rules and policies.
• They understand the cancellation terms applicable to their membership.
